Welcome to Polly! These Terms of Use govern your access and use of our SaaS professional portrait optimization platform, including the website, AI services, and associated features ("Services"). By accessing or using the Services, you agree to comply with these Terms. If you do not agree, please do not use the Services.

1. Description of Services

Polly allows you to transform casual photos into professional corporate photographs using AI, with a workflow based on Image-to-Image (img2img). It includes features like background removal, smile adjustment, eyes, lighting, and background change, using our AI models and APIs. The Services are provided "as is", without guarantees of perfect results.

2. Registration and Accounts

To use the Services, you may need to create an account by providing accurate information. You are responsible for maintaining the confidentiality of your password and for all activities on your account. Notify us immediately of any unauthorized use.

3. User Content

• Uploads: By uploading photos or other content ("User Content"), you grant us a worldwide, non-exclusive, royalty-free license to use, store, process, and modify that content solely to provide the Services (e.g., generating professional photographs).

• Ownership: You retain all rights to your original User Content. We do not claim ownership of your photos or generated photographs.

• Responsibility: You guarantee that the User Content does not violate third-party rights, laws, or is illegal. Do not upload offensive, illegal, or privacy-infringing content.

4. Payments and Subscriptions

If the Services involve payments, you agree to pay the applicable fees. Payments are processed by secure partners. We do not refund except in cases of proven technical failure.

5. Permitted Use and Prohibitions

You may use the Services for legitimate personal or professional purposes. Prohibitions include:

• Using for illegal, fraudulent, or malicious purposes.

• Reverse engineering, copying, or modifying the AI software.

• Overloading the servers or interfering with the service.

• Sharing accounts or reselling the Services without permission.

6. Intellectual Property

All rights to Polly, including the AI engine, code, and designs, belong to us or our licensors. We grant no implied rights beyond what is expressed in these Terms.

7. Limitations of Liability

The Services are provided "as is". We do not guarantee they are error-free, uninterrupted, or that the generated photographs are perfect (e.g., without facial distortions). We are not responsible for indirect, consequential damages, or data loss.

8. Termination

We may terminate or suspend your account for violating these Terms. Upon termination, you lose access to saved content, unless previously exported.

9. Applicable Law

These Terms are governed by the laws of Portugal (or EU, if applicable). Disputes will be resolved in the courts of Portugal.

10. Changes to Terms

We may update these Terms. We will notify you of significant changes. Continued use implies acceptance.
